Fyndle - Terms of Service

1. Acceptance of the Terms
Welcome to Fyndle (the "App"). These Terms of Service ("Terms") are a binding legal agreement between you, the user ("you," "your"), and Fyndle ("we," "us," "our"). By downloading, accessing, or using our App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree with these Terms, you must not use the App.

2. Description of Service
Fyndle is a product discovery platform. The App showcases products available for purchase on the third-party e-commerce platform, AliExpress. Our service allows you to browse and discover these products and provides convenient links to the corresponding product pages on AliExpress for purchase.

Important Clarification: Fyndle is not a retailer, seller, or marketplace. We do not sell, ship, or handle any products. All transactions, payments, shipping, and customer service are conducted exclusively on the AliExpress platform and are governed by AliExpress's terms and policies. Fyndle is not a party to any transaction you make with a seller on AliExpress.

3. Affiliate Disclosure
Fyndle participates in the AliExpress Affiliate Program. This means that when you click on a product link in our App and make a purchase on AliExpress, we may earn a commission from that purchase at no additional cost to you. This relationship helps us maintain and operate the App.

4. Third-Party Platform (AliExpress)
The App contains links that redirect you to AliExpress. We do not control, endorse, or assume any responsibility for the content, services, privacy policies, or practices of AliExpress. Your interactions with AliExpress and any purchase you make are solely between you and AliExpress (or the third-party seller on its platform). We strongly advise you to read the terms and conditions and privacy policy of AliExpress before engaging in any transaction.

5. Product Information Disclaimer
All information displayed in the App, including but not limited to product images, descriptions, specifications, pricing, and availability, is sourced directly from AliExpress's data feeds. We do not create, verify, or guarantee the accuracy, completeness, or timeliness of this information. Prices and availability of products are subject to change without notice on AliExpress. Fyndle is not responsible for any discrepancies or errors in the product information.

6. User Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the App. If you are under this age, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

7. Intellectual Property Rights
All content, features, and functionality within the App, including its design, text, graphics, logos, and software code, are the exclusive property of Fyndle or its licensors and are protected by international copyright and trademark laws. You are granted a limited license to use the App for personal, non-commercial purposes only.

8. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permissible by law, Fyndle disclaims all warranties, express or implied, in connection with the App and your use thereof. We do not warrant that the App will be uninterrupted, secure, or error-free.

9. Limitation of Liability
To the fullest extent permitted by law, in no event will Fyndle, its directors, employees, or affiliates be liable for any direct, indirect, consequential, incidental, or punitive damages, including but not limited to:

• The quality, safety, legality, condition, or delivery of products purchased from AliExpress.

• Any financial loss, personal injury, or property damage resulting from your transaction on AliExpress.

• Any damages arising from your access to or use of the Fyndle App.

• Any dispute between you and a seller on AliExpress.

10. Indemnification
You agree to defend, indemnify, and hold harmless Fyndle and its personnel from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your violation of these Terms or your use of the App.

11. Termination
We reserve the right to suspend or terminate your access to the App at our sole discretion, at any time and for any reason, without notice or liability.

12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law principles.

13. Changes to Terms
We may modify these Terms at any time. We will notify you of any changes by posting the new Terms within the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
